Stephen Miller lied about a Supreme Court ruling that ordered the return of Kilmar Abrego Garcia. The Trump administration is defying the Court, and a constitutional crisis is unfolding.
In April 2025, the United States Supreme Court issued a unanimous ruling in Noem v. Abrego Garcia, ordering the government to facilitate the return of Kilmar Abrego Garcia, a Salvadoran man illegally deported despite a 2019 court order forbidding his removal. That order protected Garcia from deportation to El Salvador due to credible threats of persecution.
Instead of obeying the Court, the Trump administration left Garcia imprisoned in CECOT, a notorious Salvadoran facility known for human rights abuses.
Homeland Security called the deportation an “administrative error.” But as the days pass and Garcia remains behind bars, it’s clear: this was no error. This is deliberate defiance of a Supreme Court ruling.
We Are in a Constitutional Crisis
The Supreme Court clearly instructed the government to correct the unlawful deportation and provide Garcia with all due process he would’ve received had he remained in the U.S. Justice Sotomayor’s concurring opinion was unequivocal:
“The Government has cited no basis in law for [Garcia’s] warrantless arrest, his removal to El Salvador, or his confinement in a Salvadoran prison.”
Yet President Trump has admitted that he could call for Garcia’s return “in 30 minutes”, but simply refuses to.
This is a textbook constitutional crisis. Senator Chris Van Hollen has said so explicitly:
“We are in a constitutional crisis. The President is openly ignoring the law.”
The executive branch is refusing to comply with a ruling from the highest court in the country—and publicly admitting it. If left unchecked, this precedent dismantles the separation of powers and neutralizes the Supreme Court’s authority.

Why This Should Terrify Every American
The Trump administration’s legal team argued that deportation eliminates a court’s power to intervene. In plain terms: they claimed the U.S. government can violate the law, deport someone, and leave them imprisoned in a foreign country, without consequence.
Justice Sotomayor warned exactly what this means:
“The Government’s argument implies that it could deport and incarcerate any person, including U.S. citizens, without legal consequence.”
That’s not law. That’s authoritarianism.
